should provide the leadership for state legislators throughout the country. president obama may be restricted in terms of what he can do by executive order but we are anxious to see what can be implemented by the executive branch and to realize that america, this is more in terms of common sense. when we have something that is hurting our children so much and killing youngsters around the country, it is time for all of the groups to come together and not to argue with each other because this is not constitutional rights. this is common sense. we know that those people that incorporated the right to bear arms was not talking about the slaughter of children that's happened in newtown, connecticut. so i am so sorry to see that the state legislator there that spoke earlier has made this a personal political issue, but i'm so proud that new york state has moved forward. >> if you're proud of what new york has done, obviously there's not going to be any perfect policy or perfect law that everybody's going to agree on from both sides saying that this is key perfection but do you think

in again on monday. what's the deal? >> reporter: well, craig, the reason is that the constitution states that the president has to be sworn in before noon on january 20th. january 20th falls on a sunday this year. it's the seventh time that happened in the nation's history so president obama will be officially sworn in here at the white house in a private ceremony in the blue room with families and chief justice john roberts. the day will begin with vice president biden getting sworn in by justice sotomayor. that's happening at a different time than president obama because we are told according to several officials that the chief justice at the justice department has done investigating on this, and some reporting on this, apparently biden wants justice sotomayor to swear him in. there is a schedule you willing conference and she has a book signing and they'll get that taken care of earlier in the day. the vice president and the president will head to a wreath laying ceremony at arlington national cemetery and then during the evening they will attend an inaugural reception. so it is a bus

, but it appears that they're going to try to take this to the state level to try and counter balance what president obama's going to try to do from the local level as well. the only way this gets down to what the president wants is to have a ground swelling from a grass roots level. the way he won the election is the way he's going to try to move and make some amendments to try and get some gurns out of circulation. but it's just like the mothers against drunk driving type of an issue. for a while people didn't want it, then they thought it was silly and then it became a ground swell of grass roots support. thankly it's smart for this reason. it kind of gives cover for the democrats, also some -- republicans that are looking to come forward the president's -- if the state legislators feel that type of pressure, it will trickle up in this particular instance to the federal level and they will have to make some changes. >> interesting, though, the voices coming out of d.c., talking about impeachment. i just want to play senator rand paul appearing on fox and what he was saying about preside
